Qualitex Co. v. Jacobsen Products Co. Inc. was a case considered by the supreme court of United States within which the Court considered holding that a color will consider meeting the lawful requirements for registration of trademark within the Lanham Act. This is under the provision that there has been acquiring of secondary meaning within the market. The plaintiff in this case had been using the color of green gold in the pads initiated for sale across firms of dry cleaning using the respective presses. Jacobson Products Co., also the competitor of Qualitex, was the defendant in the case. In the year 1989, Jacobson started to sell their own pads to the client base which seemed to have more or less the same color used by Qualitex.
In responding to the same, Qualitex considered filing a lawsuit against the defendant in the District Court from Central District of California (United States) perceiving the notion of unfair competition. In the year 1991, Qualitex considered registering the pads of green- gold color with the Patent and Trademark Office of United States as a trade, and in a subsequent way, considered adding the count of trademark infringement to the lawsuit. The decision taken by the District Court supported Qualitex, while the Court of Appeals for the Ninth Circuit of United States considered setting the judgment aside, perceiving the notion that solely, and color is not helpful in the registration of a trademark. Across the field, the rivalry of competition is intense in which the operators compete with one another with respect to price, and at the same point of time, the levels of service have ended up going up that forces all organizations in the industry for reducing the operating costs at minimum level crucial for maintaining profitable margins (Maximilian, 2009). However, the industry is dominated by strong competitors and hence, the intensity of competition is extremely high.
For the domestic players, the phase of entry can be considerably easy with respect to licenses and in the initial stages, there can be outsourcing of a majority of the other peripheral operations. With respect to foreign routes, the barriers for entering the market is high and there is a need for extensive planning for entering the industry as the level of competition is extremely high.
